The accuser in Jay-Z and Diddy’s rape lawsuit can remain anonymous, according to the judge

The woman accusing Jay-Z and Sean “Diddy” Combs sexually assaulted her when he was 13 years old in 2000 is is not required to reveal his identitya judge decided on Thursday, Dec. 26.

Jay-Z’s attorney, Alex Spiro, filed a motion to dismiss Jane Doe’s complaint earlier this month, arguing that the lawsuit should be dismissed if the accuser did not reveal her true identity. U.S. District Judge Analisa Torres denied Spiro’s motion Thursday, according to Associated Press.

In her written order, Torres chided Spiro for what she described as his “combative” motions and “inflammatory language” against the plaintiff’s attorney, who Jay-Z (legal name Shawn Carter) he claimed she was blackmailing him with a false claim.

Torres wrote in her complaint that Spiro, who has been working on the case for less than three weeks, has already filed “a series of letters and motions seeking to challenge the character of plaintiff’s counsel, many of which set forth the alleged ‘urgency’ of this case.”

Torres continued: “Carter’s counsel’s relentless filing of combative motions containing inflammatory language and ad hominem attacks is inappropriate, a waste of judicial resources and a tactic unlikely to benefit his client. The court will not expedite the judicial process just because the lawyer asks for it.”

Although the woman is being allowed to proceed anonymously at this stage of the case, Torres noted that she may be asked to reveal her identity later if the case proceeds to allow defense attorneys to prepare for trial.

Jane Doe originally sued Combs in October, amending her complaint earlier this month to add Jay-Z. In the lawsuit, Doe claims she was raped by the rappers after being led to a party after the MTV Video Music Awards in 2000.

Spiro has since argued for the lawsuit to be dismissed, citing “blatant inconsistencies and absolute impossibilities” in an interview the plaintiff gave to NBC. One of those inconsistencies includes the plaintiff’s claim that she traveled five hours from Rochester to watch the VMAs on an off-site jumbotron, despite permits and footage showing there was no jumbotron at the event. Spiro says the woman’s father also said he doesn’t remember driving to pick up his daughter in New York, as she claims he did.

Combs, meanwhile, remains behind bars in New York, awaiting trial on federal sex-trafficking charges. The music mogul also faces off numerous sexual assault lawsuitsmany of which were filed by plaintiff Buzbee’s attorney.
