No agreement was reached on the hospital’s process of pediatric care

TOLEDO, Ohio (WTVG) – Attorneys for Mercy Health, Nationwide Children’s and ProMedica met Friday for a hearing on a process involving all three entities. It included a lot of closed-door meetings. No settlement was reached and both sides will return to court in January.

The trial focuses on pediatric care in the area.

Mercy filed the lawsuit, alleging a breach of contract by Nationwide Children’s Hospital in an agreement it has with Mercy. Mercy sold its pediatric assets to Nationwide several years ago. Nationwide recently entered into a working agreement with ProMedica for pediatric care and partnerships, according to court filings.

Mercy Health said in court filings that it was left out of the negotiations. Nationwide said it tried to get Mercy involved several times.

That brings us to Friday’s hearing, with Mercy seeking an injunction from Judge Joe McNamara.

Attorneys for all sides also met privately with the judge for most of the afternoon. No agreement was reached on a settlement and no testimony was heard on an injunction.

All parties will return to Judge McNamara’s court on January 27.
